Q: My apartment management breached the lease agreement on water and sewer submetering
Dear Attorneys, I requested a copy of my monthly sewer and water usage report from the third party billing company and noticed that I have usages on two periods while I was away from the country. The first was 3 days and the second was 20 consecutive days. For instance, between July 9 and 29 I was in India for a conference and continued to Africa. However, it's really alarming that my water and sewer report shows consistent usages throughout the 20 days period while I was away, even as high as 120 gallons on some days. My lease agreement states categorically that I am on submetering billing for my actual usage. All efforts to seek an explanation for this issue has been futile. I visited my apartment management office twice to discuss this and have sent two emails without any reply to my emails. Management has refused to contact me to provide an explanation. My question is what recourse do I have in this case? Can I sue the apartment for breach of contract agreement?
A: It sounds like the problem is with the water company rather than the landlord. You should complain to the water company. They generalyy control the meters.
