Q: Being kick out of my apartment.

Hi my name is Taylor today I just received an email from my landlord increasing my rent drastically, and it was just for me. I call him and ask the reason why. He just said that instead of telling me to leave he is increasing it so I have time to find a place to leave. I ask the reason why he wanted me to leave and he said because we make too much noise at night and it bother the tenants, I know for a fact that is not true we don't even play music at night and we have never had a warning for making noise before. We have always pay or rent on time and now he expect us to leave when he is increasing it from 940$ to 1,190$ so I would like to know what should I do and if I pay that isn't it unfair that I'm the only one paying that also how can I move without being able to save money. thanks

A: If you have a Lease, they cannot change the amount of your rent during your lease term. Check your Lease to see what the term is and if there are any factors listed in there that would allow your Landlord to increase your rent. Typically, IF there was a nuisance (ie, noise), the Landlord would typically sent you a notice to stop making noise. If you don't have a Lease and just pay month to month, they still can't raise your rent without prior notice. You have your question in the foreclosure section. Is the building in foreclosure? If so, even if the building sold at foreclosure sale, you would have 30 days to vacate. Seems like there is something else going on here. Best of Luck! Jennifer
