Arlington, TX asked in Animal / Dog Law and Personal Injury for Texas

Q: Pit bull attacked brother & bit half off his ear off while his owner was also attacking my brother. Worth suing?

The actual owner just watched as her son in law and pit bull were attacking my brother in the alley. They are saying the dog was "protecting her home" yet my brother showed no sign of violence and had been on the property for quite some time thus it was a party he had been invited to. It has required him to have plastic surgery and missing work for over 2 weeks now. It went on to bite my other brother and they have an aggressive dog meeting tomorrow.

A: Potentially. Probably depends on whether the dog owner has homeowners insurance that could provide coverage for this type of incident.
