Q: My Husband and I separated two years ago and are not ready to rush divorce yet for family reasons but I want to

to quit dead our co owned home to him and in return I want for him to sign that he cant touch my retirement and 401K. And the new home I am currently looking to buy Can we do this without actually getting divorced. By legally separating and having a lawyer write something up that we both sign? We have no young children together

A: There is a Separate Support Petition and potentially an Agreement concerning the division of property ( which would not be final due to there not being a divorce) could be allowed by the Court.
