Q: my ex is hiding my daughter from me and is a active drug addict.
I had a daughter with my ex who lives in South alabama 7 years ago we had agreed I would have partial custody (verbal not through court) then she started making bizarre demands and after finding out she was addicted to cocaine and meth I said I was going to seek full custody at which she disappeared and has been hiding for 7 years. I recently found out she has been arrested for possession of meth and paraphonellia twice in 5 months this year and that's just that I'm aware of, I called the DHR office in Houston county where she was arrested and DHR doesn't have my daughter and they don't know if my ex is still in jail. my question is how can I find my daughter, and how hard would it be to take custody with her being a convicted drug user. I have A copy of A state certified DNA testing facility stating me as the father A. it's not my fault I couldn't find her and B. it was never established through court.
A: You can't make agreements about children "not through Court" you should file an action in the Court in Alabama (if that is where the child lives) and seek to have paternity established in you. You can file for custody, but the court is going to make that hard for you because you have no relationship with the child. You have never made a court filing in all of these years. You must do so now. It IS your fault that you never filed anything until now. Find a lawyer in the County where the child has lived and get this done.
