Q: Can I drop domestic violence charges (misdemeanor) on husband and ask for divorce?

Police came and took pictures and he was arrested Saturday afternoon I was issued an emergency restraining order. So far in the system it appears as a misdemeanor charge... it was just a small cut on lip and my face and ear were red from all the pressure he applied. Can the charges be dropped even if he has a domestic violence charge on him from a previous partner or will that affect the judge's decision. I just want a divorce and that's all I ask for and we both go our own ways. We have no kids or property together. If he does stay in jail how long might he do. He currently was in his second year of probation and he already does have two strikes. What might the outcome be?

A: first you have to understand you are a witness not a victim............the victim technically is the state of calif...............

think in terms of a robbery at a liquor store and you are arrested. If later you learn that your parents are best friends of the owners and the owners want to drop chances are no dice.
