Q: Can a school allow "hearsay" in witness statements from students when describing an incident?

The new HS band director is an ex-military bully. I've made complaints, my son has stood up to him, and the principal loves him because he is also former military. The teacher prompted some students to fill out witness statements that included lies, exaggerations, and hearsay (I heard he said that the teacher should shoot himself). This escalated a referral for punishment (for "profanity" and saying the teacher should shoot himself), eventually getting him kicked out of band. My son is an honors student who has never had a discipline problem, and the entire incident is a lie. Is hearsay allowed? If not, how do I fight this? I swear I'm not exaggerating.

A: A school is not a court of law. Therefor hearsay is allowed.
