Asked in Child Custody and Child Support for Alabama

Q: How do I get legal custody and physical custody of my son and drop my child support payments to the mother?

I pay child support so if I get legal custody is she required to pay me instead of me paying her- (Even if I owe her some back-time child support)? She drops my 6 yr old son off at my house without permission while I'm at work (and came right into my house without knocking) after telling her I can't get him that day bc we have no way to get him back & forth to school. So she leaves my son with my current girlfriend at my house, demanding she keep him, says she won't be back for a week to get him and says we are responsible for taking him to/from school, lunch $ & snack $, leaves no clothes, food, insurance card or money for him, then leaves! PS: I have no legal custody, joint custody, physical custody. It's never been to court. Only my name is on the birth certificate, dna test proved he is mine, & I pay $67 weekly child support. The mother won't let me get him on any terms except for her own and it's in a demanding way! I know I have rights as a father, but what do I need to do?

A: You go to Court and file a petition to make you the legal father. You demand custody of the child and show that custody with you is in the child's best interest. Then, you would have custody of the child and she would pay support to you for the benefit of the child.
