Q: We live in NJ, and we got married 7/18/15 (2 years and 4 months ago) the photographer never sent us our photos

We have a written contract and proof that we paid her $750 (she was also 2 hours late the day of our wedding) she just got there right when the ceremony was starting, so she didn't take any photos while we were getting ready. She's been promising us our photos for over 2 years, never received them. I have numerous emails & text messages stating she will send them. I recently contacted her and she signed a written agreement to send me $1000 by 9/30/17....never received it. I contacted her and she basically told me to take her to court she doesn't have the money to repay me. As I said the amount I paid her was $750, how much additional can I sue for (damages/pain & suffering) Also is there a statute of limitations since it's been 2 years & 4 months? Thank you in advance for your advice.

A: Sounds like you might have a good case for consumer fraud. Get an attorney to file a complaint. The NJ consumer fraud act (CFA) is excellent and permits plaintiffs to collect treble damages including recovery of attorney fees. The purpose of the CFA is to stop unfair business practices like you've described by making it cost-effective for consumers to to sue.
