Q: Do I need an elder law attorney if I already have an estate planning one?

Essentially, there is some overlap, but elder Law attorneys focus more on protecting assets against long term care costs (Medicaid planning) - this maximizes our client's quality of life as much as possible.

A: I agree with Attorney Neufeld. The roles of an estate planning attorney and a elder law attorney have some overlap but it depends upon your legal needs. If looking at long term care issues, then a elder law attorney will be important.

A: That is a very good question. Some estate planning attorneys also understand and practice in the area of elder law; however, some others do not. Elder law is a sub-specialty of estate planning, so it is important to make sure that your estate planning attorney has the special knowledge to help you make an elder law or asset protection plan. If your lawyer is not comfortable practicing elder law, he or she should refer you to an attorney that does.
