Glen Head, NY asked in Criminal Law for New York

Q: If you are charged with a misdemeanor for petit larceny, does a background check show the exact nature of this charge?

For example, will the background check have the words 'petit larceny' in it or does it just list the fact that you have an upcoming court date for an ambiguous charge?

A: It really depends. Your adverage “background check” likely won’t show it; if they do you can maintain your innocence and get a lawyer to have it taken down.

The only place it will be (unless someone messes up...which happens a good deal) is on WebCrims NYWEBCRIMS.com I think but google NY webcrims and you will find it.

If this is for a job or school, I would suggest hiring a private attorney to help handle these matters (either only in that capacity) and the case...shouldn’t be too expensive.

Remember always you are INNOCENT UNTIL PROVEN GUILTY BEYOND A REASONABLE DOUBT 97%-98%. Hey how are you are convicted you have no obligation to say anything about it.

I hope this was helpful,
