Q: Can you sue in small claims if defendant’s lawyer did all the agreement & filing when plaintiff no longer has a lawyer?
For 6 months, the plaintiff didn’t have a lawyer. I’m the defendant. I won full child custody during the school year & every other weekend in the summer. We settled out of court. But my lawyer had to do a lot of communication between the both of us which I was charged for. Plus the paperwork & filing it. I feel that I should be able to get some of my money back from the plaintiff since they didn’t have a lawyer.
A: You are out of luck on this one. The plaintiff is not entitled to pay you. It was your choice to hire a lawyer and hiring a lawyer was for your benefit, not the plaintiff's.
