Q: i was considered at fault for an accident involving an uninsured driver
I was turning right at a stop sign when a driver sped past me and hit my front corner of the drivers side. I was ticketed for failure to yield and also another because i couldn’t find my insurance in time before my car was towed away. The police told me i can just bring in my insurance on the court date and it would go away. The other driver that hit me just had a wheel blow out while my entire front was damaged and had to be replaced. He did not have insurance. I was claimed at fault because there was no proof that he was speeding and he had his girlfriend(a witness) and i had no one. My dad said it was better to not make a claim with insurance and pay it myself(I’m younger and the car was my dads a luxury car)but the boy who hit me wants to make a claim against my insurance. The only information he has of me is the police report, my phone number, and my name. He has the same court date as me.(my name is not on the insurance card either) state Illinois. Is there anything i can do?
A:
You do not provide sufficient details for any of us to render a definitive causation opinion. If you made a right turn from the left lane, you probably ARE at fault for failure to yield the tight-of-way to the car in the right lane.
If you are at fault, you or your insurance Must bear ALL related expense.
In car witnesses, whether your name is on the insurance, and who owned the car you were driving have nothing to do with anything.
