Q: Can an employer be liable for a car accident?
My son was asked my his manager to run an errand to another store. While clocked in and on his way to the other store he rear ended someone. We have insurance but due to his age and history we do not want to put a claim in on the insurance. He just bought the car 2 months ago. Can the employer be responsible for the damages to his car?
A: Your son should have made a police report and he MUST report the accident to his employer as it MUST be processed through the employer's insurance. Your insurance would reject the claim because you do not have coverage for "business" use of the car. Hopefully, the employer has at least one vehicle with business insurance.
A: If your son was hurt he will be covered by workers comp. As to damage to the vehicle, they will hopefully cover but I don't know that they are responsible at law to the employee if the employee uses their own car.
