Q: Can I get residency of my 13 yo due to mom not being able to help him with hw & he got convicted by juvenile court?

his mom has said she is not able to understand the homework but also she just doesn't make him do it. Also, he was convicted by a juvenile court this past year for criminal trespassing while under his mother's supervision. She knew he was trespassing in this building and even encouraged it.

You have mentioned only two things about mom's shortcomings, but there may be 25 good things about her child raising behavior. The court will look at what is in the best interests of the child after considering all of mom and dad's good and bad points.
