San Diego, CA asked in Immigration Law for Arizona

Q: wife came to the US on a tourist visa of 10 years. Need to change it to permanent residency but time is running out

What do we do? How much money do we have to send with the papers and which papers do we send? Should she go back to her country and then return? CAN she??? How much time would she have to wait in her country?

A: More information is needed. Are you a US citizen? If you are and your wife entered the US legally then her overstay (assuming that is your question) would be forgiven and she will be able to adjust her status while remaining in the US. If you mean that your wife entered with a B2 visa and her authorized 6-month stay is expiring then she may need to return to her country or you must show that her immigrant intent did not exist at the time of entry. I strongly recommend consulting with an immigration attorney.
