Q: I filed a chapter 7 and do not want to keep the home. Was I suppose to include the Foreclosure Court on mailing matrix?
I did not reaffirm the home in Chapter 7. Foreclosure Court said they were not aware of the Filing. Was I suppose to include them on the mailing matrix. I need the stay there so they do not proceed with foreclosure at this time. The only thing I received was the initial complaint months ago from the mortgage company. When I called the courts to make sure they were aware of the filing they said they were not. Can I send them a copy of the Form 309A as proof of the bankruptcy
A: You were not supposed to include the court. You were supposed to include the bank's lawyer in the case. Send the Notice of Filing to them as you proposed. The matter should be stayed until your case is over.
A: If you are looking to keep the house, you may want to look into filing a chapter 13 bankruptcy.
A: Give the Foreclosure Court a copy of the Notice of Filing, and Meeting of Creditors Notice. Also amended the Petition to include (notice purposes) the Bank, and their Counsel.
