Q: Can I get my ex's rights terminated?

When my ex got out of prison in February 2017 he took me to court to set up child support and visitation. He got both. He has since (Now December 2017) made one $50 payment not even for a week. He has also stopped showing up for visits. He showed up to 6-7 visits. Was late almost every one or left early. He hasn't seen her since April 2017. We have seen him out in public at Walmart and he walks right by my daughter. My husband has been wanting to adopt her. But I'm not sure how to start this process.

A: If your husband is willing to adopt her, he can file a petition for adoption. If your ex defaults or doesn’t contest it, it very likely will be granted. If he does contest it, you will have to show that he is an unfit parent (ie prison, abandonment, lack of acknowledgment of child) and that it is in the child’s best interests that the adoption be granted. Consult an adoption attorney in your town who can guide you through the process.
