Q: Can my ex have my husband's income used in court to reduce the amount of child support he has to pay even though I work?
I work as an independent contractor so my income varies and my ex knows that my husband makes a substantial amount of money and has threatened to request that my husbands income be used in court instead of mine to reduce the amount of child support he would have to pay under the new child support laws in Illinois. I had an attorney but my attorney recently and unexpectedly passed away. My husband and I also have a child together that we support. Can my ex legally do this. Is there anything I can do to protect my husbands income from being brought into court or is it recommend that I hire an attorney? Also if it helps my ex is only allowed 2 overnight visits a month which was just recently granted, so he will have her 26 nights in a year as I know that is also taken into consideration with the new Illinois Child Support Law. We also provide all the medical coverage and my ex has never contributed towards any medical. Any input is greatly appreciated!
