Q: Can my son's father force him to spend time with his new girlfriend instead of coming home with me while he is at work?
We have 50/50 legal and physical custody and the agreement states no parent should withhold time with the child. However my son's father is in his fifth new relationship in 8 years and is forcing my son to spend time alone with his new girlfriend during vacation while he's at work my son would rather be home with me during the day as I am laid off has father refuses to allow me to pick him up my lawyers are going to be filing a new agreement however they will not be available till tomorrow and I'm not sure what my rights are as far as not forcing him to stay there. Should I be allowed to pick him up he has expressed to his therapist he would rather spend the time with me then with a stranger. I do not want my son to be put through another break up as he has had to deal with five women coming in and out of his life and now he has separation issues. Please help.
A: You should wait to contact your attorney and the rule of thumb is to obey current court orders until they are modified.
