Q: Parental visitation right while waiting for a divorce hearing

My husband left with our children 1 month ago, after assaulting me. The police did not arrest him because there was no injury and he denied assaulting me. He has refused to let me visit the kids. I hired a lawyer and filed for divorce, but the court date is not until February 2018. My lawyer said there is nothing I can do right now until the court date, because my husband has the right to take the kids away. But what about my visitation right as their biological mother? I would like a second opinion and/or additional actions I can take in order to see my kids before the court date. Thank you

A: Rely on the advice of your attorney. You will have to wait until the scheduled court hearing. However you should contact you husband by phone, and email every few days requesting to see the kids for a "visit", lunch, dinner, movie, or other age appropriate activity.

You should record the phone calls, and keep a diary of what's said, and also detail emails, and all other relevant matters in it. You should continue with diary entries after the divorce. It will be important to have in future . Good ✔️luck.
