Colonial Heights, VA asked in Real Estate Law and Landlord - Tenant for Virginia

Q: What is Virginia's law on family owned property. One sibling lives in the home & is not allowing the others in.

Sibling has taken out warrants, protective orders against other siblings as a way of keeping them off the property. Family has attempted to file something with the courts. Have been told only an attorney can do that. What action can the family taken.

Parents are deceased and there are seven siblings. The property is listed in all the siblings' name. Since one sibling actually lives in the home, he's attempting to control the property by now allowing the other sibling to enter on the premises and taking out warrants and protective orders against other siblings. Have been told by the told by the courts that only an attorney can file charges.

A: Depends entirely on how the property is owned and any number of other facts not present. A lawyer would want to schedule a consultation with you to discuss your case in full detail to determine what steps can be taken to safeguard the property and everyone's rights.
