Olivehurst, CA asked in Child Custody, Child Support and Civil Rights for California

Q: Want to leave current home and return to parents as 16 year old!

I am 15 about to turn 16 and wouldn't take any action untill i was 16 but currently i live with my aunt and uncle in Tenessee. I constantly find myself in an argument with them and would no longer like to live there for depression reasons. If i were to leave i would live with my parents again, who only sent me to live with my aunt and uncle untill they got a job again. Now they have a job again and live in California, i believe they could take the propwe care of me and provide a home where i am not in any danger! If i were to leave my aunt and uncle would do anything to force me to return. I want to know if there is anything they could do or if this is a bad idea! I little more info, my parents gave my aunt and uncle power of attorney do my aunt and uncle could provided healthcare, anyway what are my options here! Thx

A: As a minor under the age of 18, your rights are very limited and are controlled by those who have lawful custody of you. Perhaps you could hire the services of an attorney in Tennessee to advise you how to improve your situation. Have a conversation with your parents and tell them you don't feel comfortable or safe with your aunt and uncle so far away from them.

My fear is that there is a lot of information you are not providing, both about why you are in Tennessee and why your aunt and uncle have a power of attorney over you instead of some kind of custody agreement with your parents.
