Q: Can i exit a lease when my ex-gf has begin smoking pot illegally to my state and the community I live in?
She has begun smoking again now that we broke up. She has now brought it into the home which puts me in jeopardy of being removed from the property along with her due to HER illegal action. I've been told going to the police will just end up fining her and a slap on the wrist and then everything will just go back to normal. I need a permanent fix. I know leases are subjective, making it hard for you to completely answer the question, but would you think there may be a way to exit the lease early due to something that is out of my control without having to pay heavy penalties? I paid the entire deposit and would like the majority of it back and also leave the property. Any hopeful answers with that solution?
A: You don't provide the one piece of information necessary to answer the question: Is her name on the lease, or just yours? If her name is not on the lease, file a forcible entry and detainer action (commonly called an eviction) and get her out. If her name is on the lease along with yours, your best bet is to sit down with the landlord and explain the situation and see what he or she is willing to agree to.
