Q: What can father do to get & keep full custody & what is best way to ensure he gets full custody? (Mother is unfit)

The father (noncustodial) has lived & is still living in Oklahoma with kids for the past two years with mutual agreement from mother without a custody arrangement. (Mother had minimal contact visits one day every other holiday & one phone call ever few months.) Mother (custodial) who lived & is still living in Arkansas got a divorce & was granted full custody because she lied about having a phone number & address for the father. Never notified the father of court so she was granted custody because father didn't show up. Mother had custody for 4mnths & is claiming he owes CS & never notified father she had custody or asked to have the children back or made an effort to see or contact the children. The father still has children one is enrolled in school & DHS, family Dr, school, & the childrens counselor knows father has had kids for 2yrs & know how little contact the mother has with the kids. Can the father go to jail for just now finding out about the custody? Can he keep his kids

A: He needs to get an attorney to help him asap!!! If he does not act immediatly this situation is going to quickly get worse.

A: You have a big mess to get unwound. You should consult an experienced Family Law Attorney, in your area, for help with this problem immediately. It would appear that the Arkansas divorce is "voidable", and since Oklahoma is now the "Home State" of the children, you may file a custody action here. Good luck.
