Q: daughter is in fear of husband going back to WI to file for divorce to make her return with kids. Is a domestic abuse v

the husband is currently in jail for abuse to my daugher and my oldest grandson, age 12. They have only been here for one month, He states that in WI they will make her come back, but they have no place to go. She is the worker, not him and is currently applying to go to school. Can he make her bring the children back to WI while she is in fear of him?

A: Theoretically, yes. But it's probably not likely in my opinion. My guess is that he is bluffing.

A: Yes he certainly has the right to do that; however, you can object and look to relocate from Wisconsin to Florida based on a number of different factors that are within Wisconsin law. You should hire a very good, experienced matrimonial lawyer in the local Wisconsin area. Do that now in an effort to preempt his filing so as not to have to look over your shoulder for the next five or six months while waiting the Florida six month statutory jurisdictional period.
