Q: I pay $100.00 a month in alimony. This month I have had sever financial hardship and was not able to pay my spouse

I feel and cracked ribs and I have spinal stenosis a death in the family, my car may be repossessed. My spouse refuses to give a extra month to pay the Alimony. I plan to pay her from my tax return I have two pending operations and months of Re-Hab I am an Insulin dependent diabetic and I can not pay the co pays for the Meds.

I have had three instants of diabetic coma. The Judge is not sympathetic with my problems. I left my marriage because I was gay and I married my partner of 20 years. Since the marriage my ex wife has made our lives a living hell.I can not afford an attorney. She intentional filed our joint return during our separation leaving out my Social Security Wages and when they came after us for the money. she claimed innocent spouse. She took the state return for the same year a sum of $600.00 forged my name to the check and kept the money I was forced to make payments to the IRS for about $2000.00 may be less. We simply don't know what to do We need some help

A: You should consult divorce counsel as the alimony laws have changed. Generally,if your situation has materially changed since the divorce, you can consider filing a Modification petition and Motion for temporary orders based upon your health situation unless you have surviving alimony in which case extraordinary circumstances need to exist- any they may possibly from your health issues description.
