Bronx, NY asked in Traffic Tickets for New York

Q: I received a letter for a NY speeding ticket that I received 2 years ago that never went to trial. Can it be dismissed?

The letter requests I see someone for a Pre trial. The ticket was issued in November 2015 and I sent back a not guilty plea right after I received it. I just got a letter in 2018 for a Pre trial!

A: If you waited more than 2 years you can file a motion to dismiss pursuant to People v. Thorpe, 160 Misc.2d 558, 613 N.Y.S.2d 795 ( App. Term, 9th and 10th Judicial Districts, 1994).

A: The delay in scheduling the conference is not grounds for dismissal. At the conference, you or your attorney will have a chance to conference the case with the Town Attorney and negotiate a plea to a reduced charge with less points
