Forest Hill, LA asked in Child Custody, Civil Rights and Domestic Violence for Louisiana

Q: What rights do I have and what should I do if my sons mother refuses to respond and plans to alienate me from my 5yr old

I am his legal father and supported the mother the entire 9 years of our relationship and all but the past 10 months of my sons life. We lived together with me being the only one employed 8 of those 9 years. We struggled financially but lived comfortable enough and never needed for anything. Approximately on 05/10/2017 we both agreed we didn't belong together and together agreed of the best way we could separate without affecting our son in anyway and still be fully involved in his life as single parents. We agreed to live the rest of the week and gently let him know that his mother and he was moving that weekend. We always got alone no matter what especially for him and things went great that week until she misread a text in my phone. She was crying and angry the called her parents to move her things out that day.I didn't try to convince her other wise and tried to calm her down. Her concerned parents called the police and she falsely accused me of hitting her and I was arrested prom

A: I gather you're asking what you can do to see your child if his mother won't voluntarily let you. The answer is to petition the court to determine your custody and visitation rights. A lawyer can help you with this. Give me a call and I'll be happy to discuss further.
