Katy, TX asked in Bankruptcy and Foreclosure for New Jersey

Q: I filed Chapter 7 bankruptcy in NJ and was discharged 08/2010. I included my mortgage (surrendered it).

I moved out of the house 05/2011. I moved to Tx 3 years ago. I was in the process of buying a house and just found out that the said property went into pre foreclosure 08/2014, it is still under pre foreclosure. I can't get a mortgage because the title is still under my name. My question is, how can a lawyer help me with a deed in lieu for foreclosure to get my name out of the property? Can I do a quit deed instead?

A: You need to retain an experienced NJ mortgage foreclosure defense attorney to handle this matter for you. Pick the best lawyer you can find and remember one rule: a good lawyer is generally never cheap, and a cheap lawyer is generally never good so don't choose based on price.

A: You do not need a lawyer initially. Call the bank and say you want to do a deed or a short sale. See what the response is.
