Oakland, CA asked in Legal Malpractice for California

Q: My attorney has committed numerous counts of malpractice. Who can I complain to?

I hired a law firm for an affirmative case on contingency. After misrepresenting me in court and coercing me into agreeing into something I wasn’t in agreement and promising to recuperate the loss through the affirmative, he decides to file a motion to withdraw. He emailed me that he felt that he could not continue to represent me under contingency and assumed that I wasn’t willing to pay per hour fees, which, for the record, he NEVER once asked me, if I’d be willing to change the contract from contingency to per hour, yet, he has lied to the courts in his declaration stating that I did not follow his advice, that I am difficult, and so on and so forth; all are untrue. Moreover, I find out about this motion via an email sent by his staff; I was NEVER properly served, yet, there two Proof of Service signed by someone “declaring under penalty of perjury” that he had served me by personal delivery and mail; this NEVER happened, as the server and I have NEVER met EVER. Is all this ilegal

A: You can file a complaint with the State Bar (http://www.calbar.ca.gov/Portals/0/documents/Regulation/2015_ComplaintFormENG0915-r.pdf), but it seems that you need to find another attorney.
