Q: I received a speeding ticket in NC but it doesn't appear on my NY driving record. Will a court in NYS be able to see it?

I had no tickets for years but got a speeding ticket in NC in August while on vacation (I live in NY). I wrote the DA and mailed in the ticket but never heard back. Apparently they never got my letter or ticket because they convicted me of the charge and "failure to appear." I chalked it up to my bad luck and just paid the fine. I just got a ticket for using an electronic device in NY (I was just plugging it into the charger but that's still illegal, so the ticket is valid). When I got my driving abstract, the NC ticket wasn't on it. I found online that traffic violations from out-of-state don't appear on NY driving records. My question pertains to what the court in NY can see. Will the court be able to see the traffic conviction from North Carolina even though it isn't on my NY driving record?

The answer to your first question is no. The NYS DMV will not record a traffic infraction conviction from NC on your NYS driving record.

The answer to your question question is yes, but they won't check. Your conviction is another state is admissible and considerable in a subsequent prosecution. However, rarely will a prosecutor or police officer, when prosecuting a traffic infraction in NY, search for traffic convictions in another state.
