Q: Grandparents rights in oklahoma when single parent goes to jail.
My sister went to jail and her youngest daughter she has custody over. She verbally said i want my mother to be her care giver while i am in jail. She has not filled any paper work out we are afraid her father who is not on her birth certificate and has been absent in her life due to being in prison is going to try to take her. he does not have custody of his other children only supervised visits. We are not sure what process we should take or how to go about starting all of this.

A lot depends on how long she is expected to be in jail. If only a few months, I wouldn't worry about it since there has not been contact with the child, and he is not on the birth certificate. To do anything, he would have to hire an attorney, and file a paternity action, and mom, and persons who have custody would have to be notified.
