A: It is possible your alimony will terminate if you live with your boyfriend. I would need more details to give you a definite answer such as the date of divorce and the terms of your divorce agreement and details about your planned living arrangements. You could benefit from a consultation with an attorney on this matter so you know how to correctly proceed.

A: Your alimony will be terminated if you live with your boyfriend. You can count on that being the likely outcome.

A: Thank you for your question. I understand how worried you must be about maintaining your alimony payments.

The short answer is possibly. New Jersey has a statute which sets forth various factors to determine whether a recipient of alimony is considered to be “cohabitating”. That same statute also sets forth what happens to the alimony payments if in fact the court determines that the alimony recipient is in fact cohabitating. The answers are not always clear cut and an experienced family law attorney will be best able to help you apply the factors in the statute to your particular situation.
