Palmdale, CA asked in Domestic Violence and Criminal Law for California

Q: Isn’t him putting me out on the street like this itself an act of Domestic Terrorism, committed against myself?

My name is Lisa. I'm in Lancaster, an outlying suburb of LA County. I've been thrown out of the house and put out on the street since September by my husband of 24 years, and who has changed the locks to the house entrance. We've five kids there, too; three are still minors.

This past September, I took my name off the lease because the owner raised the rent another $100 and I didn't want to have to incur any more consequences to our credit. But the police have told me that because I did this I have no recourse but to go to the local courthouse, where I have been told my only remedy is to file for divorce, which I have done.

The owner had nothing to do with this, so I was never served and kind of papers. So my second question is: Since my husband and myself are only tenants there, have I not been therefore wrongfully evicted and/or, Isn’t him putting me out on the street like this itself an act of Domestic Terrorism, committed against me?

A: if you were married he can not put you on street like that....but that is not domestic terrorism or violence in my opinion.

you should be able to have police accompany you to return to home.

divorce papers would have to be filed to get you out legally.
