Q: Can a mother voluntary give up her rights to avoid child support?
The 2children are under the guardianship of grandparents until 18. The mother is constantly back in forth to court seeking to give up rights. Father still has rights
Also,since I am married to the father..can I adopt them n keep them in the custody of gparents??(father incarcerated)will I have to pay child support?
A: If the mother has constantly failed after going to court trying to give up her rights, it should be evident that she can't do so as a way of avoiding her obligation to support the children. Whether you can adopt your step-children is up to the court. If you succeed in adopting them the parental rights of their biological mother will be terminated and her obligation to pay on-going support will end (though her obligation to pay support due through the date of the adoption remains an obligation).
