Q: I have a question about tort law for UM insurance offset laws.

I had a Ms policy and have already been giving the full amount of the policy that the person who wrecked Into me held. Now my own personal insurance company is trying to offset the amount and owe nothing because they are protected under Ms tort law for UM. My question is let’s say the policy is 25k and their clients Insurance has paid the full amount of the policy. Now my own insurance company is trying to offset that amount and owe nothing. I have not signed anything and haven’t accepted the settlement. I am entitled even with the offset to my medical bills being paid by my own insurance company?

An insurer may not offset Medpay payments to the insured against UM coverage. Prudential Prop. Cas.Ins.Co. v. Mohrman, 828 F. Supp 432,438 (S.D.Miss.1994
