well he is also an alcoholic and has an opiod addiction.
he also knows when hes getting drug tested so hes stops a few days before. well ive been checking his location on my phone from work and i have noticed that he has been taking our 2 yr old son with him to pick up percocets illegally. what can i do about this? he is on unemployment and stays home with the child while i work but i do not want my son involved in this type of activity even though he does not know what is going on at his age yet it is not fair to him. i just want his father caught and out of our lives.
A:
Thank you for your question. I know how worried you must be about your son’s safety.
The short answer is that the Court is required to determine the best interests of your son and ensure that your son is safe at all times. In New Jersey, in all cases involving the custody of a child, the court must always determine the best interests of the child. Custody is comprised of both “legal” and “physical” custody. The court must apply several factors to determine the best interests of the child while weighing the rights of both parents as well as the right of the child to continuing and frequent contact with both parents. It is important to protect your interests and have an experienced family law lawyer explain the various factors the court will consider to determine what custodial arrangement is in your son’s best interest and ensure that your son is safe and protected at all times.
