Q: Can I get compensated for the neck injury damages I got because of an accident with a DUI but not my fault as agreed?

The DUI part was taken care of and I get my license back by the man part is the civil case that an arbitrator provided by the third-party said that I am at no fault and the case was closed the accident occurred in September 2016

A: You can can sue but you can recover only economic damages (past and future wage loss, medical expenses and property damage). Under Civil Code 3333.4 you cannot recover pain and suffering damages if you were operating a vehicle in violation of Section 23152 or 23153 of the Vehicle Code, and were convicted of that offense.
