Myakka City, FL asked in Car Accidents, Gov & Administrative Law, Traffic Tickets and Wrongful Death for Florida

Q: My father was killed by a reckless driver and the agency (FHP) handling the case is negligent, what should I do?

It has been two years in Wakulla, FL and they have not sent us a final accedent report (only preliminary). One officer claimed the blood work was not back, another claims THC was found in defendant's blood. Defendant was pulled over, a few months after killing my father, for felony speeding and let off with a warning. We were not informed of the court date until hours before. Only charges brought against defendant was careless driving. We have witness saying his driving was erratic and defedant was speeding. Judge did not even know a fatality was involved in the case until my brother informed the judge in court. States attorney office is not even involved. Court date is being rescheduled, but I feel something is terribly wrong and I don't know what I should do in order to prepare for the new court date or for proper representation on our behalf.

A: You should have already and now need to consult with a personal injury attorney in the area where the accident occurred ASAP.

You can use the find a lawyer feature of this site to locate a personal injury / wrongful death attorney in the county or near the county where the accident occurred.

A: Contact a member of the Fla Justice Assn--they give free consults. Unlikely you have a case against Fla HP as courts don't review decisions not to investigate or prosecute in most cases & states.
