A: Typically if you are the custodial parent you are entitled to child support and where the other parent lives does not effect this. If you have a divorce agreement, child support is usually set out in these agreements. I suggest that you consult with a family law attorney to review your agreement and advise you of your rights and how to proceed.

A: Thank you for your question. I am happy to assist.

I understand your concerns relating to child support. If you live in NJ and the children primarily reside with you, you will be entitled to support so long as your spouse’s income warrants same. Depending on the circumstances, you may need to file for support to be enforced by the State where he currently resides. In any event, you are likely to receive support if you have primary residential custody of the children. Based on your circumstances, it would be best to contact an experienced family law attorney to address your specific concerns.
