Q: Can my landlord use a old rental agreement with my signature & different address on it to evict me from a new address.

I lived in one side of a duplex back in July of 2017 I signed a lease and by October 2017 the other side of the duplex became available and i moved in and we’re given a new lease to sign but never signed it or returned it. We stopped paying rent due to failure to make necessary repairs in December of 2017 and in January 2018 the gave us our first notice and now today we were given the Eviction notice which we will go to court for except the documents I have the same ones which were filed with the courts do NOT MATCH. The amounts of which we owed are different from the first notice & the lease they filed with the courts is our previous lease with our signatures for the other side of the duplex and dates from when we originally moved in to the first side of the house back in July 2017. Are they legally allowed to use this previous lease ? Are they allowed to mark out the address and amounts and write the current ones below it. Would this be considered falsifying evidence ?

A: If you have not paid rent in full, then the lease might not matter, and the court could evict you. A written lease is not even required. Whatever issues there might be with the lease, either written or oral, if you still are behind on your rent, the court could grant an eviction. If not this time, then landlord can give you another notice, file a second eviction, and get an eviction the second time.
