Q: My divorce occurred in FL he stayed in FL, I live in NJ, I tried filing for CS in NJ I was told I can't what can I do?

I have been divorced for 13 yrs. he always gave something but now its less and less and inconsistent, I have three sons with him and I am trying to have consistency here, is there anything I can do? I don't have the funds to move the judgement from FL to NJ is there anyway around this please help.

I understand your concerns relating to child support. If you live in NJ and the children primarily reside with you, you will be entitled to file for support. However, the Court may be indicating that you cannot file for a number of reasons. One being that the divorce was not registered in the State of NJ and, second, because the Court’s here do not have jurisdiction over your ex. Depending on the circumstances, you may need to file for support to be enforced by the State where he currently resides. In any event, you are likely to receive support if you have primary residential custody of the children. Based on your circumstances, it would be best to contact an experienced family law attorney to address your specific concerns.
