Q: My Father died Nov. 8,2017 I have had a will from him since Sept. 2010. He died in Abilene, Tx. I live in S.C.

I had a stroke on Nov. 11, 2017. The lawyer in Abilene filed the probate papers. I cannot travel due to stroke. My sister made a will using the papers from a will she had back in 2002. You can tell the paper she filed is pasted together with the date changed to Oct. 18,2017. She had two Wittnessess sign this paper. One witness is a drug dealer in Abilene. I did not know the other person...

My sister filed this "Fake Will".

My sister's actions after Dad died became strange begging me to give her half. I have a witness to this! My sister before Dad died he was in hospital and she had her husband call Dad's Lawyer asking him to come to the hospital because Dad wants to change the will. The lawyer said "No."

My dad had a massive tumar in his brain. It even caused him to go blind...

What steps do I take to prove this will is a "Fraud"???

A: Hire a probate lawyer in the county in which your father died (and/or owned real property) to present the Will for probate and, if your sister has presented what you believe to be a fake Will, to contest that. Inform the Texas probate lawyer that he may need to call the lawyer who said "no" as a witness.
