Q: Underage/Unlicensed Driver
I have 3 girls that were in a car accident. One of the girls stole her mother’s car and allowed her friend to drive it. There was also 1 sitting in the back seat. The girl whose mothers car it was is now the passenger and her friend crashed it. Car is now totaled out. Who is liable to pay for the payments on the old car?
A: The owner. The bank doesn't care about who wrecked the car. The owner may want to sue the parents of the child who wrecked it for negligence, but be careful throwing stones in glass houses. The owner, whose child allegedly stole the car, may have some liability as well.
