Fresno, CA asked in Domestic Violence for California

Q: What are the consequences for me if I recant my statement in a domestic violence case?

For years I've been abused verbally and physically, but the night I talked with the police officer I told him that my husband hit me but he didn't, he only was insulting me and calling me names in front of my 2 kids, and he also broke the back window of my car, I still waiting my green card for 10 years if I recant my statement can affect my status?

A: To properly evaluate any legal question a lawyer needs a thorough summary of the facts.

This involves not just your interpretation but what the other side is saying too.

If you are not clear then the lawyer will no doubt be challenged to correctly respond. It is the old adage: “Junk in, junk out”.

On any legal question you should contact a local lawyer focusing on this area of the law and present him/her with ALL the facts.

That way your lawyer can talk to the DA or Judge to successfully resolve your case.

Recanting your story can sometimes resolve the matter and sometimes expose you to potential perjury for yourself.

you need to talk to a criminal attorney who knows immigration.
