Q: Can my parents visit me ? Eventhough i have over stayed
I have overstayed my time, but i got married before my time was up im currently waiting to start filing in couple months. However my parents want to visit me, will this affect them or me in any sort of ways?. ( note we all have tourist visa)
A: If your parents already have valid visitor visas in their passports, I imagine they are less likely to experience any problems related to the fact that you have overstayed your status, in that they would not be disclosing such information to an embassy official in connection with a new application for a visitor visa. That being said, there is of course no guarantee that a U.S. Customs & Border Protection (CBP) officer would not give them a difficult time upon entry using even the valid visas already found within their passports. Whether a CBP officer would even question them about your status is uncertain, and if you are in the process of pursuing permanent residency stateside through, for example, a marriage-based petition for relative and application to adjust status case, perhaps the officer would understand why it is they intend on visiting (e.g., meet your spouse, etc.) - again, if the officer even asks.
