Q: I am 22 years old, DACA expired 3 years ago if I marry someone who is 18 how can I go about getting legalized?
I also have 2 misdemeanors. 1 as a minor, the other at age 18. Will i need a lawyer ?
A: Anytime an individual going through (or hoping to go through) the immigration process has criminal history, it is wise to schedule a consultation with a competent immigration attorney. Be sure to bring with you copies of documents from your criminal case(s), particularly copies of the police arrest report(s), charging document(s), plea agreement(s) (if applicable), final judgment(s) and sentence(s) (if applicable), proof of completion of judgment(s) and sentence(s) (e.g., termination of probation) (if applicable), pre-trial intervention / diversion program agreement(s) (if applicable), proof of completion of pre-trial intervention / diversion program agreement(s) (if applicable) and notice of nolle prosequi (if applicable). As you have had DACA previously, you should also bring with you all documentation you have related thereto and documentation from any other immigration case you may have, including but not limited to documents from any removal (deportation) proceedings. How you entered the United States and what precisely is your criminal history can impact whether and how you can move forward with one type of case vs. another type of case. Again, speaking with an attorney in the context of a consultation is advised.
