Lynwood, CA asked in Criminal Law and Domestic Violence for California

Q: What can I do to avoid more jail time?

I am homeless female and was arrested for misdemeanor domestic violence for two weeks before I was released. A week later we are asleep and the cops open the door at 4am pull me out of our car and arrested my for violating the TRO although my fiance asked for them to not to put it on there at the original hearing. We were both asleep no drugs no mischief. The officer who arrested me was there and just recognized the vehicle and took a wild guess. After they took me my partner was left alone no further questions asked. They told him if he's seen with me again they will arrest is both. He doesn't have a record at all. Why do I have a target on my back when there are tons of homeless using drugs and stealing. How can I improve this situation we want to see each other.

A: more info is needed.

it sounds like you or someone else called the police to report you for DV on your boyfriend and a "keep away" order was issued.

did you get notice of a TRO (restraining order)?

you need a lawyer to appear and remove the ordered
