Q: Do I have case when contract calls for painting existing cabinets and installing custom cabinets.
After demo says can’t paint because not wood (even though he looked at them day of contract signing and said were wood) cabinets or make custom cabinets. I had to buy all new cabinets and counter tops. Was not changing counter. Took $20k in June for materials because supposed to start in two weeks. Just started 30 days ago. Asked for bills and to see materials in supposed storage facility and refuses. Is there a fraud case here as I relied on the contract to my detriment so far in the amount of $5500 dollars? Further I have incurred the cost of two storage units since July to house all the items on my lanai and deck that he demolished in September and has still not rebuilt. Also lost the use of my hot tub that I use for therapeutic therapy as I am disabled by a neuromuscular disease? Thank you for your insight.
A: It's probably not fraud, but appears to be breach of contract on the part of the contractor.
